Obtaining information is the key to proper legal advice and action.
We can obtain information using the Data Protection Act 1998, Freedom of Information Act 2005, under common law, other statutes and Rules of Court.
These can be free-standing applications for information for defined purposes or in order to obtain information to help with a wider legal case.
Examples of information regularly obtained include:
• Health care records
• Social service records
• Records from Government agencies
• Pre-action disclosure in potential court cases.
There are a number of data protection principles including that data (which can include personal sensitive data) should be kept securely, checked for accuracy and relevance and updated or deleted if no longer accurate or needed.
Often organizations holding data do not keep up-to-date or accurate records and this can be challenged and rectified.
